Government Ready with Final Draft of Real Estate Bill


The Government of India is ready with the final draft of a real estate bill that makes it compulsory for developers to disclose key aspects like carpet area and layout and promises a safety net for prospective homebuyers. If the Real Estate (Regulation and Development) Bill, 2011 is cleared, developers can even be jailed for up to three years for making false promises to customers, many of whom invest their life�s savings for a place they can call their own. The jail term could be in addition to a penalty of 10 per cent of the total project cost. The proposed law envisages a Real Estate Authority to regulate all developers. All developers will have to register with the authority, the first such body in the sector. The draft has been sent to the law ministry. Once cleared by the ministry, it will be presented to the cabinet before it is tabled in Parliament. The proposed act says developers have to disclose the carpet area, layout plan of the proposed apartments, structural design and plans for other on-site development. Builders cannot change plans or insert charges after the sale agreement is in place. The draft says developers will have to upload on the proposed authority�s website all certificates and details that can be accessed by any future customer. The act will bring a sea change in access to information that buyers have at present. The regulatory authority�s website will act as an interface between buyers and developers. Developers cannot float fancy advertisements to attract buyers. If there is any deviation from the advertisement, the promoter has to compensate the buyers for any loss because of the false information. If a builder pulls out of a project, the money has to be returned with interest at not more than the prevailing market rate. The bill also addresses the problem of disputed property. Since there have been cases where developers have used such property to build multi-storeyed apartments at attractive rates, the bill stipulates �full and true disclosure� of the nature of the title of the land to be developed. If the land is owned by any other party, the developer has to upload the agreement with that party. Under the draft law, developers cannot publish advertisements till projects are registered with the regulatory authority or force buyers to pay an advance without the sale agreement. If there are any �structural defects or deficiencies� in a building within �a year of allotment�, they will have to be �rectified by the promoter�. The bill envisages an Appellate Tribunal, to be headed by a retired Supreme Court judge or a retired high court chief justice. The tribunal can start investigations on its own if it receives a complaint of violation.

72% brokers and 60% buyers time their property buying decisions with the festive season

New Delhi, 24th October, 2011: A survey conducted by 99acres.com, revealed that the ongoing festive season will bring in cheer in the real estate market. 70% respondents said that freebies and exciting offers during the season do affect their property buying decisions. When we asked the brokers about their outlook for this festive season then 44% said that the demand for new property will go up.
If we further analyze the data city wise, then buyers from Delhi were very optimistic about purchasing property during the festival season. 68% buyers in Delhi, 60% in Mumbai, 57% in Bangalore and 50% in Chennai said that they time their property buying decisions with the festive season. Echoing the same sentiment, 84% brokers in Delhi feel that buyers prefer to buy property during the festive season.
Commenting on the trend, Vineet Singh, Business Head, 99acres.com said “.The festive season is an auspicious period for consumers and we have always seen a lot of deals come through, during this season. He further added “With both global and Indian economy on the precipice of a slowdown and with real estate already under stress for the last 10 months, it is definitely a good time to buy homes. Prices are at attractive levels across India and even though home loan interest rate is high it makes sense to buy now. Interest rates will come down in the next 9-12 months. Also, the slowdown seems to be a temporary blip so one should look at investing now”.
When questioned about the property price trends post the festival season, 58% brokers responded that prices will be stable in the coming months. The survey was conducted among 4000 buyers and approximately 250 brokers in India.

Delhi circle rates likely to be hiked by approx 200pc

New Delhi:

Central Government is likely to increase circles rates in posh colonies of national capital by approx 200percent. According to the senior officials of Delhi Revenue department “government has taken this move to deter the irregularities of market and it would push up property prices, so that government does not lose revenue from registration fee and stamp duty.”
Whereas in several cases properties prices are not mentioned on paper so due to this government loses revenue on stamp duty and registration fees, the added.
However in the first quarter of this fiscal year city government has increased the circle rates by 100 percent.
Also said that circle rates has been proposed to be increased in the range of 50-200percent. However, the department is thinking on the proposal and soon will come out with the results, officials said. They added that, the hike may be around 200 per cent in posh colonies like Defence Colony, Golf Links and Gulmohar Park.

No property transaction on POA:SC

The real estate sector is now under pressure following to Apex court’s latest judgment regarding the immovable property. The Supreme Court has ordered that any deal or transaction of immovable property will be considered as “illegal” through power of attorney (POA) unless the case is “genuine”.
According to market analysts argued that it is very difficult to point out the market size of POA deals, on the other hand several other sector watchers “especially in Delhi northern India 70 percent of the property deals are could constitutes.” The Supreme Court has alleged that there is extensive use of POA to transfer of Properties in the national capital, Punjab, Haryana and Uttar Pradesh, to put a stop to the practice and check generation of black money.
Realtors are used to use POA extensively from last several years it has become a trend in real estate sector to avoid taxes, thereby generating black money.
According to market experts as well as northern states, slum re-development properties and housing boards in Maharashtra have also seen significant levels of POA transactions. Huge number of real estate deals has done through POA. They added that, POA is also the common way to get done the slum redevelopment properties and housing boards in Maharashtra have also seen significant levels of POA transactions.
In the aftermath of the judgment huge number of property transactions will be severely changed, the number of transactions is unlikely to be impacted, early assessment suggests.

Good entrepreneur always have to be agile and proactive towards its business. He or she must have to continuously hunt for better tools to improvise the level of his business. On the contrary, many entrepreneurs who often tend to grow but they become rigid towards their certain opinion. They make strong perception in their own mind and it becomes very difficult to come out of that perception.

Lalit K Nagar is the owner of a growing trading organization which deals in electrical equipments. They often provide components to electrical manufacturing companies and they also import product and sells them directly to the market through a distribution channel.

Mr Nagar, employees around 25 sales professionals. The average age of the sales workforce is less than 30 years and the working hours in office is 9:30 am to 6 pm. Any of his staff is not authorized to browse on internet which is not related to the core functional area of his or her responsibility. Mr Nagar has strict policies against social media as he does not want any of his employees to spend time on it.

Although he has certain strong opinion regarding this medium and he don’t want to change this, but there are facts that some of his competition is using this medium effectively and accessing potential customers through this.

Since, Mr Nagar himself do not spend much time in the field to interact with their customers, he does not have this knowledge that his customers are actively using social media. This knowledge gap and understanding gap is letting his business facing a challenge of registering growth.

Resistance from employers to embrace social media and new ways of working could be a major barrier hindering the future potential of most of the Indian smaller businesses.

HR experts who specialises on SMEs business environment often urge employers to move away from a ‘one size fits all’ approach to employee engagement and to make their organisations more receptive and supportive of younger generations and the new skills and experiences they have to offer.

At almost every forum that emphasize on the factors that can bring growth for SMEs, technology has been identified as one of the key drivers. But this also exposes a big gap between traditional employers and the new generations entering the workforce.

Although these forums always highlights the issues for effective and sustainable growth and these forums get rich participation by the entrepreneur community but how effective would these talks could become if people don’t usually implement the new ideas into their business. Time is changing, what we have now was not their 10 years ago, and similarly what we have now will not going to be their in next 10 years. So, their should be no conventional ideology in the frame of an entrepreneur. The mind has to be open for new ideas, and courageous enough to experiment those ideas.

But the realistic picture has to be kept in mind and realistic approach should be taken

‘Retail trade policies should attract SMEs’

The World Association for Small and Medium Enterprises (WASME) has called for a comprehensive retail policy that would help the SMEs grow on a sustained basis and help the Government address their issues more effectively. WASME has demanded a comprehensive trade policy to regulate domestic trade sector and called for treating small retailers on par with Micro, Small and Medium Enterprises (MSMEs).

The president of WASME B U Girei of Nigeria called upon governments to treat SME retail trade enterprises on par with other SMEs and accord them industry status. He observed that though they contribute substantially to GDP, and employ large number of workers, next to agriculture, is still not given the status of MSMEs in many developing and emerging economies. Any impact on these enterprises implies that a major chunk of population will be affected.

Gyan Prakash Agarwal, secretary general, WASME, highlighted the relevance of small retail sector to the general economy, both in terms of employment generation and contribution to GDP.

A seminar organized by WASME in Noida recently highlighted that the absence of a comprehensive retail trade policy makes the entire retail operations directionless and also provides less chance to these MSM retail enterprises to fight for their interests. Though policies/ laws exist, they are on different aspects and are administered by different agencies/authorities.

The seminar also highlighted the need for an official definition for retail trade enterprises and according them a status of MSMEs; need for building up a proper data base of retail enterprises; scope for linkages with large chains/retail stores; and more importantly putting in place an effective regulatory mechanism to preserve the interest of MSM retailers.

The seminar was attended by academia and industry representatives. It was organized in the backdrop of Government of India’s plan to permit 51 percent foreign direct investment (FDI) in multi-brand retailing.

Housing development is linked to consumer durables

Housing development is directly linked to the fast moving consumer durables. If one have place to live, he will need all the nessicities of life. Traditionally Indian real estate industry has been characterised pre-dominantly by need-based and end-user transactions, which are quite different from most of the international markets, where investment related transactions, constitute a significant chunk of the overall market activity. Housing development opens the way for purchase of household items like, clothing, furniture, and other electrical items. It also generates demand for interior designers and decorators, housing loan providers, washing machines, television sets and other home appliances with which it has forward linkages. For the healthy growth of real estate industry, an integrated approach to housing and its related activities that include institutional support to the industry, is needed. Land as a resource has always been precious. The government have to recognize the fact that the healthy growth of real estate is directly linked to the development of house hold item producing industry. Building industry also needs to be revamped and recognised on strict enforceable rules and regulations since the lives of millions of people depend upon it. Consumerism can not develop without the development of housing development at present and is passing through times when the housing industry is just beginning to take off. It is high time government recognise housing development as separate economic activity for the purpose of computation of GDP by delinking it from banking and other financial services with which it is clubbed at present. This would be in consonant with the practice followed by matured economy. It is only then the health of economy will be measured with housing activities and established direct linkage. The government will have to play a more proactive role as a facilitator. Housing is and has been the core activity in human habitation. Housing industry is giving the maximum taxes to the government to function, so it must be given priority and the place it deserves.

IDBI reduces interest rates on housing finance

As property market is falling down due to rise in property prices as well as home loan rates are also increasing day to day. So the biggest home loan provider banks have decided to slice home loan rates to magnetize the borrowers particularly when Diwali like festive season is ahead.
Recently IDBI bank has taken a robust action, just has announced 25 to 50 basis points reduce in interest rates for its existing home loan customers. Earlier, Dena Bank had reduced its lending rate on housing finance by 25 bps. On the other hand Bank and housing finance companies are increasingly seeking to tie borrowers to fixed-cum-floating rates, as interest rate seems severely hiked across the country.
Contrary to this, Reserve Bank of India (RBI) has increased the interest rates several times from March 2010 to till date. According to market analyst anticipating, “the bank to go for one final hike at its meet to review interest rates on October 25.”
IDBI Bank has also launched a fixed interest home loan scheme for new customers following to HDFC Ltd, LIC Housing Finance and ICICI Bank.
